Carlos: If you are a foreigner with an extraordinary ability, the US immigration system has a great solution for you. That’s what we’re going to talk about in this video. Hello from Freedom Group. So, in this video, we’re going to talk about the eight most common questions that we get on the O-1 visa. And to do that, I’m going to bring our immigration attorney Mr. Roberto Montalvo. How are you Roberto? 

Roberto: I’m good. Carlos, how are you?   

Carlos: Good. Good. Roberto is our immigration attorney here at Freedom Immigration. And he’s going to answer the top eight questions concerning the O-1 visa for the U.S. immigration process. So, Roberto, what is the O-1 visa? 

Roberto: The O-1 visa is a nonimmigrant visa that is specifically designed for gifted people and or athletes that have a special ability in the sciences, the arts, business, athletics, motion picture education or the television industry. 

Carlos: Okay, so and then what are the benefits of the O-1 visa compared to other immigration visas? 

Roberto: You get the ability to work in the US, you also, once approved, you get the status for three years, and then you can file one-year extensions without a cap on them. You can bring your family with you, it’s also eligible for premium processing that way you can do the process a little faster, and there’s no annual visa limits put in by the U.S. government.   

Carlos: Okay, so what are their requirements for the O-1 visa? 

Roberto: Well, the main one is you have to prove you have an extraordinary ability, you must have national or international acclaim, you must be sustained, you must work in the field of your extraordinary abilities. Like even if you’re like a very exceptional scientist, you can’t then just start your own business in a different field.   

Carlos: Okay. 

Roberto: Your employment must qualify as an event. And the petition must be made by a US employer or agent, you cannot petition yourself. And you must also have an advisory opinion by a peer group in the U.S.   

Carlos: Okay. And then what are the documents that are needed to process the O-1 visa with the Immigration Department? 

Roberto: The basic ones you need a copy of your passport, you need resume evidence of extraordinary abilities like publications, awards, you need the advisory opinion from the peer group, any letters of recommendation, you need an employment contract, and to explain the specific work that you do, or are going to do in the U.S. 

Carlos: Okay, and is getting an O-1 visa hard to get or is it an easy process? 

Roberto: The standards for an extraordinary ability are really high. But if a person does possess these extraordinary abilities, then it would be a lot easier to obtain this type of visa. 

Carlos: Okay. And then one of the most common questions we get on the O-1 visa is if I get the O-1 visa, can I get a green card? 

Roberto: You can get a green card through the O-1 visa. But once you’re in the U.S, you can then adjust status if you have another way of adjusting. Let’s say like if you’re married to a U.S. citizen, you can then adjust your status to a green card holder based on the marriage, not the visa. 

Carlos: Okay. And how long does the O-1 visa process take? 

Roberto: With COVID nowadays it is really hard to calculate specifically. If you’re in the U.S, it’ll be a lot faster because if you do premium processing, again, if you’re in the U.S. legally you do premium processing you get a response within 15 days. If you’re outside the U.S. once your petition is approved, you have to wait to schedule the interview with the embassy. That’s what takes the longest time and it’s very unpredictable. 

Carlos: Okay. And then the most common question that we get concerning the O-1 visa is with my O-1 visa, can these people bring their family members over to the U.S? 

Roberto: Well on your O-1 visa, your spouse and your unmarried children can come to the U.S. under what’s called an O-3. Okay, but your children can go to school but your spouse nor your children can work here- they cannot. 

Carlos: Okay, so now you know these are the top questions concerning the O-1 visa. Roberto, if someone wants an O-1 visa what do they need to do?
